On Monday, September 26, 2016, a client implementation support analyst filed a Fair Labor Standards Act Complaint in Northern District of Georgia federal court against Athenahealth, Inc. She filed an overtime claim on behalf of herself and others similarly situated, which includes those working in other positions performing similar duties who worked for the company during the past three years. The Complaint alleges that Athenahealth improperly classified its client implementation support analysts as exempt from the FLSA's overtime protections. The Complaint alleges that in this position, the client implementation support analysts performed non-exempt work that included in person and telephone customer support.
According to Plaintiffs' counsel Matthew C. Helland of Nichols Kaster, PLLP, "Plaintiff and other client implementation support specialists worked long hours without any overtime pay. It is our understanding that Athenahealth will be paying overtime going forward, but these employees deserve their back wages as well." The Complaint seeks unpaid overtime wages, double damages, and attorneys' fees and costs.
Athenahealth provides medical records software and services to hospitals and medical groups across the country. Athenahealth, Inc. is headquartered in Watertown, MA with other office locations throughout the United States, including in Atlanta, Georgia.
The case was filed in federal court in the Northern District of Georgia, Court File No. 1:16-cv-03592-SCJ. Plaintiffs are represented by Matthew C. Helland and Reena I.
