On Friday, April 24, 2015, we received a great decision from our Judge regarding the discovery requests we received from Centene. The Judge denied Centene’s request to conduct discovery of the opt-in Plaintiffs before it was required to respond to Plaintiff’s motion for conditional class certification. According to the Court, the information that Centene sought regarding opt-in Plaintiffs’ specific job duties and employment conditions was not “germane at the conditional certification stage.”
As you are likely aware, on March 12, 2015, we filed our Motion for Conditional Class Certification and Court-Authorized Notice. If the Judge rules in our favor on this motion, Centene will be required to provide us with a list of all similarly situated case managers. We will then mail notice of the lawsuit to these individuals and invite them to participate.
