Homeowner Represented by Nichols Kaster, PLLP Fights LenderLive’s Illegal Mortgage Fees

A homeowner borrowing from LenderLive Network, Inc. (“LenderLive”) filed a civil class action lawsuit against the lender on July 12, 2016, in the 18th Judicial District Court in Arapahoe County, Colorado. This lawsuit is filed as a breach of contract claim on behalf of the Plaintiff and all others similarly situated, which includes borrowers nationwide who were charged a loss inspection fee by LenderLive in the past three years. The Complaint alleges that these inspection fees are contrary to the terms of borrowers’ mortgage agreements and reasonable commercial standards of fair dealing. Moreover, the Complaint alleges LenderLive was unjustly enriched by these fees.

LenderLive is a Colorado based mortgage services provider that serves more than 300 financial institutions nationwide.

Plaintiff is represented by Kai H. Richter and Lyndsey R. Jorgensen from Nichols Kaster, PLLP, which has offices in Minneapolis, Minnesota and San Francisco, California. The case was filed in the state court in Arapahoe County, Colorado, Case No. 2016-CV-31701.
