A former employee of Michaud, Cooley, Erickson & Associates, Inc. (“Michaud”) filed a class and collective action lawsuit on April 13, 2016 in the United States District Court for the District of Minnesota for violations of federal and state overtime laws, seeking unpaid overtime pay on behalf of himself and all similarly situated employees who worked for Michaud within the past three years, as well as damages and other relief on behalf of himself for claims of retaliation.
In the complaint, the plaintiff, a former staff designer, alleges that Michaud failed to pay him and similarly situated hourly employees the legally required overtime premium of one-and-one-half times their regular hourly rates for all overtime hours worked. He alleges Michaud only paid him “straight time” for his work hours. The plaintiff seeks unpaid overtime wages and liquidated damages.
Plaintiff's attorney Rebekah Bailey stated, “We believe Michaud short changed its employees by failing to pay them overtime premiums in compliance with state and federal law. Through this lawsuit, we seek to recover unpaid overtime premiums.”
