As you know, Hilltop filed a motion to dismiss the case and compel arbitration. In other words, Hilltop wanted the dispute to be decided by an arbitrator, not a judge. We opposed Hilltop’s motion and won. The judge agreed with us that the case should remain in federal court in Ohio. Now, Hilltop is appealing the ruling against it to the United States Court of Appeals. These sorts of appeals typically take several months to play out. We anticipate an argument in front of the court of appeals in early 2014. Even if we were to lose the appeal, your case would still proceed before an arbitrator.
