Judge Conditionally Certifies Class of Prospect Mortgage Loan Officers Seeking Overtime and Minimum Wage Pay Represented by Nich

On August 24, 2011, a federal district judge conditionally certified a lawsuit involving loan officers represented by Nichols Kaster, LLP, seeking overtime and minimum wage compensation from Prospect Mortgage, LLC. This means that all persons who are or have been employed by Prospect Mortgage as loan officers at any time from August 24, 2008 to the present and were paid on a commission-only basis will be provided notice and an opportunity to join the case.

The case is entitled Sliger et al. v. Prospect Mortgage, LLC, Civ. No. 2:11-cv-00465 (E.D. Ca.). The loan officers seek overtime compensation, minimum wage, and other relief under the Fair Labor Standards Act and California state law. Plaintiffs are represented by Robert Schug and Matthew Helland of Nichols Kaster, LLP, which has offices in Minneapolis and San Francisco.
