Unitek USA and FTS USA Hit With Overtime Lawsuit by Cable Technicians Represented by Nichols Kaster

Two more cable companies have been sued this month for wage and hour violations. The lawsuit was filed in the United States District Court for the Western District of Tennessee. The case is brought by current employees who work as technicians for FTS USA and its parent Unitek USA. Both companies have their corporate headquarters in Blue Bell, Pennsylvania, providing installation and service to the cable television industry. The plaintiffs allege that they were unlawfully denied overtime pay under the Fair Labor Standards Act. They bring their case on behalf all technicians who worked for FTS and Unitek within the past three years in any location across the
country.

"This is the second lawsuit we have filed this month against a cable installation company," explained Rachhana T. Srey, one of the Plaintiffs' attorneys. "Wage and hour violations appear to be an industry problem. These employees are only paid by piece-rate and are not compensated for any of the time they spend performing work that benefits the company, including all of the overtime hours they put in."

Plaintiffs are represented by Donald Nichols, Paul J. Lukas, and Rachhana T. Srey from Nichols Kaster, PLLP in Minneapolis, Minnesota, and Donald Donati and William B. Ryan from Donati Law Firm, LLP in Memphis,
Tennessee. The case is entitled "Monroe et al v. FTS USA, LLC and Unitek USA, LLC," Case No. 08-cv-02100, W.D. Tenn.
