Understanding Your Rights as an Employee

All workers—including full-time, part-time, and temporary workers, as well as employees, independent contractors, executives, laborers, and others—have certain rights. Many of these rights are federally protected, while others are governed by state or local statutes. It is important that you fully understand your rights as an employee, as this allows you to know when an employer has violated those rights or otherwise tried to unlawfully take advantage of you.

Some of your basic rights as an employee in the U.S. include:

  • The right to a workplace free of discrimination and harassment
  • The right to fair pay for hours worked
  • The right to overtime pay (for non-exempt employees)
  • The right to reasonable workplace accommodations
  • The right to report workplace discrimination and harassment without retaliation
  • The right to take protected leave, such as leave under the Family Medical Leave Act (FMLA) (if applicable)
  • The right to report unlawful practices by filing a whistleblower (qui tam) claim without retaliation

If an employer violates an employee’s rights, the employee can bring legal action against the employer. By suing an employer or former employer, you can seek compensation for certain damages you have experienced as a result of the employer’s wrongful conduct. Depending on the specifics of your case, these damages can include unpaid wages, lost income, back-pay, reinstatement, emotional distress, reputational damage, and more.
