Judge Approves $425,000 Settlement in Class Action Lawsuit Brought by Janitors Working at Macy’s and Herberger’s

On March 29, a federal judge approved a proposed class action settlement resolving claims that Capital Building Services Group shortchanged employees who cleaned Macy’s and Herberger’s stores in Minnesota. The company will pay $425,000 under the terms of the settlement and implement a number of changes to its business practices moving forward. In the coming weeks, class members will receive claim forms that must be filled out in order to participate in the settlement. The case, Hussein v. Capital Building Services Group, was filed in 2015 by eight current and former janitors represented by Nichols Kaster attorneys Paul Lukas, Carl Engstrom, and Adam Hansen. The employees alleged that the company violated a number of state and federal labor laws, including failure to pay minimum wage and overtime.
