On July 28, 2016, two field technicians filed a lawsuit in the District of Minnesota seeking overtime pay from West Shore Group, Inc., for themselves as well as others who worked as field technicians for the company. The field technicians allege that West Shore Group illegally paid its field technicians on a flat rate/"per-job" basis and that the company failed to pay field technicians for the time they spent driving between worksites throughout the day. As a result of these pay practices, West Shore Group failed to pay its field technicians overtime pay when they worked over 40 hours in a week, and in some cases, failed to pay them the minimum wage. The lawsuit seeks these unpaid wages plus liquidated (double) damages.
The field technicians are represented by Paul J. Lukas and Brittany B. Skemp from Nichols Kaster, PLLP in Minneapolis, Minnesota. The case is entitled, Netzel v. West Shore Group, Inc. Case no. 0:16-cv-02552 (District of Minnesota).
