Nichols Kaster, PLLP Wins Punitive Damages Verdict for Railroad Worker

On Thursday, March 5, 2015, a jury in the Western District of Wisconsin returned a verdict of more than $425,000 to Michael Koziara, a former employee of BNSF Railway Company. Koziara was represented by Matt Morgan, Jim Kaster and Nick Thompson of Nichols Kaster, PLLP. Koziara brought a claim for retaliation under the Federal Railway Safety Act, 49 U.S.C. 20109, based on his assertion that BNSF retaliated against him for reporting a work-related injury. On Thursday, a federal jury agreed, awarding Koziara $175,724.65 in lost wages, $125,000 in compensatory damages for emotional distress, and $125,000 in punitive damages.

This case is titled Mike Koziara v. BNSF Railway Co., No. 13-cv-834-jdp (W.D. Wis.).
