A current employee of Mattress Firm, Inc. filed a lawsuit in the Northern District Court of Georgia seeking overtime pay. This employee brought the case on behalf of Managers on Duty who worked for Mattress Firm nationwide within the last three years. In the employee’s complaint, he alleges that Mattress Firm misclassified him and his co-workers as exempt employees and unlawfully failing to pay them overtime compensation as a result.
Mattress Firm is a retailer of mattresses and other bedding supplies and has over twelve hunderd locations nationwide.
Plaintiff’s attorney Paul Lukas stated, "The overtime hours worked by these employees is significant. Mattress Firm commonly required them to work in excess of fifty (50) hours a week to cover these sparsely staffed stores. It’s failure to pay this group of employees overtime also appears to be an intentional violation of the law considering it was sued for the same conduct in a case it settled in Florida in 2010.”
