The Court’s ruling does a few things. First, it allows us to proceed through the discovery phase of the case as a group, rather than in multiple individual cases. Whether we can proceed to trial as a group is a determination that the Court will make after discovery. Second, it allows us to send a letter (“notice”) all loan officers who worked for Embrace within the last three years informing them about the case and giving them 60 days to join. This is an important moment in the case, and we are very pleased with the Court’s decision.
We mailed the Court-approved notice to 219 current and former Embrace loan officers on September 22, 2014. In order to participate in the case, these loan officers must fill out the consent form enclosed with the notice, and return it to Nichols Kaster by Friday, November 21, 2014. The consent form may be returned by mail, email, or fax. An original signature is not needed.
