On November 17, 2014, a former sales consultant for Ideal Image Development Corporation (“Ideal Image”) filed a proposed collective action lawsuit in Tennessee federal court seeking overtime wages. Ideal Image is a provider of laser hair removal and other non-surgical cosmetic medical services. It operates centers in 27 states throughout the country, including Tennessee.
The lawsuit alleges that Ideal Image misclassified its sales consultants as exempt, and as a result, failed to pay them overtime wages when they worked more than forty (40) hours in a workweek. This case is entitled, Marlow v. Ideal Image Development Corp, Court File No. 3:14-cv-00540-PLR-CCS (Eastern District of Tennessee).
Plaintiff’s attorney Brittany Bachman-Skemp stated, “We believe that Ideal Image’s sales consultants and those who worked in similar job titles do not fall within any exemptions to the overtime laws. These employees worked long hours without the proper compensation. We are pursuing back pay and additional double damages for these employees.”
