On November 19, 2014, two former employees of Branch Banking and Trust Company (BB&T) filed a proposed collective action lawsuit in North Carolina seeking unpaid overtime and minimum wages. BB&T is in the banking industry, and offers numerous financial services. This case is entitled Ketner & Baker v. Branch Banking & Trust Co., Court File No. 1:14-cv-967 (Middle District of North Carolina).
The lawsuit alleges that BB&T failed to pay those who attended and graduated from its Leadership Development Program (LDP) proper overtime wages when they worked more than forty (40) hours in a workweek. The case also alleges that BB&T’s “Training Cost Agreement” (TCA), which BB&T requires its employees to sign as a condition of employment, violates federal wage and hour laws.
"BB&T has a policy and practice of enforcing the TCA against those who end their employment within five years of graduating from the LDP, a policy that we believe results in wage and hour violations" explained Rachhana T. Srey, one of the Plaintiffs' attorneys.
