We recently received an important ruling from the Court on the parties’ motions for summary judgment that we and PHH filed simultaneously. We asked the Court to rule as a matter of law that the time Mortgage Advisors spend inside the real estate offices is not considered “outside” under the outside sales exemption (the exemption that PHH is claiming applies to its Mortgage Advisors.) Defendants took the position that any work MA’s performed inside the real estate offices were not at a “fixed location” that serves as the “employer’s place of business” under the relevant regulations. The Court ruled in our favor on our motion and denied Defendants’ motion.
As of now, the trial is set for November 3, 2014. We are in the process of reevaluating that trial date with the Judge and determining a trial plan. We will post another update when we have further information.
