Tucker Communications Employee Represented by Nichols Kaster Files Action to Recover Overtime Pay

On October 3rd, 2011, Plaintiff Keith Jones filed an action against Tucker Communications, Inc., on behalf of himself and other similarly situated, regarding overtime in the United States District Court for the Middle District of Georgia. The Complaint alleges that Plaintiff Jones was not paid proper overtime pay for his overtime hours worked as technician, installing cable, high-speed internet and telephone devices. Tucker Communications contracts with digital network operators, such as Charter, and provides installation services.

The case alleges that Tucker Communications violated the federal Fair Labor Standards Act and was filed on behalf of current and former installation technicians who work or have worked for Tucker Communications. Plaintiff Jones alleges that he and other installation technicians were not paid properly for the overtime hours they worked due to the piece-rate payment scheme the company uses to compensate its technicians.

Plaintiffs’ attorney Reena Desai stated, "Failure to pay installers proper overtime pay appears to be a problem in the cable and satellite television installation industry. These technicians work long hours each week and are often only paid on a piece-rate (per job) basis for each job they complete. We intend to help installation technicians recover any overtime wages they may be due under the law."

Plaintiffs are represented by Matthew H. Morgan and Reena I. Desai from Nichols Kaster, PLLP in Minneapolis, Minnesota, and John T. Sparks from the Austin & Sparks, P.C. law firm in Atlanta, Georgia.

The case was filed in the Middle District of Georgia and is entitled Jones, et al. v. Tucker Communications, Inc. Court File No. 5:11-cv-00398.
