Nichols Kaster, PLLP Brings Suit Seeking Overtime Pay Owed to Cable Installers Employed by Wave Comm, GR, LLC

UTICA, NY--(Marketwire - March 29, 2010) -  On March 25, 2010, Nichols Kaster, PLLP filed a putative collective and class action lawsuit for unpaid overtime wages on behalf of cable installation technicians that worked for Wave Comm, GR, LLC. The lawsuit was filed in the United States District Court for the Northern District of New York. In the Complaint, the employees assert that Wave Comm violated the federal Fair Labor Standards Act and New York Labor Laws by denying overtime pay for all hours worked over forty in a week. 

Plaintiffs' attorney Tim C. Selander explained, "Paying an employee on a 'piece rate' basis is acceptable, but employers are still obligated to pay their employees overtime wages when they work more than forty hours in a week. Our clients routinely worked overtime hours and were not properly compensated."

Plaintiffs are represented by Paul J. Lukas and Tim C. Selander from Nichols Kaster, PLLP in Minneapolis, Minnesota and Nelson Thomas from Thomas & Solomon, LLP in Rochester, New York. The case is entitled Johnson et al. v. Wave Comm GR LLC, and Robert Guillerault and Richard Ruzzo individually, Case No. 6:10-cv-00346, N.D. New York.
